subject to existing easements, restrictions, reservations and roads of record,
if any. Buyer and Seller to sign real estate contract and to deposit $5,000 down
in non-refundable earnest money, day of auction. Balance in certified funds upon
closing and Seller providing marketable title on or before July 8, 2008, unless
